RE: Release of Information from a Confidential Service by Ibrahim - written 02/10/2008 16:33:12
Hi Wendy

A court order trumps the DPA and you have to attend and disclose any data asked.

Hi Ibrahim

One of our Working Womens Confidential Health Services  has had a rquest to release information on one of its patients which they refused but they have now been issued with a court application for one of their team members to act as a witness at court providing information to the defendants solicitors and I wondered if the application is approved, is the member of staff obliged to attend court with the information?  The crime is classed as serious but its not the police requesting information, its the defendants solicitors.  The impact on this service if information has to be released will be detrimental to the confidence of its users and we feel they should be afforded this protection.

Any help or advice you can give, would be very much appreciated.  Kind regards, Wendy
