RE: Surveylance of an individual by Ibrahim - written 24/07/2008 17:33:13
Hi Nick

The short answer is there is no need to notify anyone.

The court will though need to take account of any breach of privacy when assesing any evidence gathered through covert means.

In a matrimonial disput one party has hired a detective to establish if the estranged spouse is having an affair. The investigator has used varous devices, camera and sound detection equipment, to establish evidence of adultery.

A) Is it a legal requirement to notify the Poilce and the suspected offender or his/ her solicitor and

B) If such notification should be made to the supposed offending person should this notification take place before, during or after all survelance has bee undertaken?

Thanks & regards,

Nick
