RE: My mother-in-law was a Communist by Ibrahim - written 04/01/2008 14:54:41
Hi Barry

My article on access to information about the deceased looks at the law in this area.

She certainly still has a right to confidentiality and so the information may be exempt from disclosure if you make a request under FOI.

This should not stop you though. It would help your cause if you are the personal representives of the deceased or if you can show that she would not have object to or would have wanted you to access her information. This would assist the authorities to assess whther disclosure would be a breach of confidence.

Also note that the security services have a number of other exemptions they can rely on to withold information.

Hope this helps. Good luck and thanks for supplying the most interesting question.

Hello Ibrahim,

My mother-in-law immigrated from the Soviet Union before WW2. She was a member of the British Communist Party in London for many years. She died in 2001. My wife and I are trying to fill out her biography. Is there any way to see the files that the security services or immigration service must have had on her?

Thanks,

Barry
