RE: records of discussions with unions by Ibrahim - written 19/03/2012 21:27:25
Hi James

The union view is incorrect. The Information is held by you and so potentially disclosable.

You may be able to claim the section 36 exemption (public affairs) subject to obtaining the opinion of the Qualified Person and carrying out a public interest test.

Also the records may contain personal data (section 40) and/or commercially sensitive information (section 43).

Ibrahim,

We have had a claim from unions that records of dicussions belong to them and cannot be released as part of an FOI request. These discussions take place during regular engagement meetings.

Would section 36 be applicable in this case?
