I have come across some provision we provide for learners that have mental health issues. The organisation that effectively contract us (although it’s not that formal) to provide the provision have said they are not happy with us requiring their learners to sign our enrolment form. This has a funding implication which I am following up but I think also a data protection implication. The rationale for not requiring the learner to sign is that they are not of sound state of mind and would not understand what they are signing.



I’ve not been able to find an guidance on how to deal with this situation outside of medical treatment, do have any pointers?
