RE: CCTV and RIPA by Ibrahim - written 23/02/2010 17:44:29
Hi James

There is no RIPA issue here as long as the CCTV cameras are overt and there are signs up to say that CCTV is in operation.
You still need to consider whether you are complying with the CCTV Code under the DPA which is available form the ICO website (www.ico.gov.uk).

If you decide to use the cameras in the future for a pre planned targeted operation to capture a person "at it" then there may be a RIPA issue even if there are signs.

We have CCTV systems in use at our Civic Amenity Sites. We have received a number of complaints from members of the public that scavening is taken place on site without challenge by any Council employee.

In order to reply to the complaint we have viewed our CCTV footage for a period of time in order to prove that this was actually taking place. We have discovered that it was and now intend to remind the employees on the site of this fact and the need to challenge any person they see removing items from the site.

The CCTV system is registered for the Detection and Provention of Crime etc. At no tiime have we monitored any employee.

Does RIPA apply anywhere in this process?
